Terms and conditions for using the service

General Terms and Conditions
1. These Terms and Conditions of QWATT OÜ (registration code 16373039) (hereinafter referred to as the Seller) apply to all Users of the https://qilowatt.lv e-shop.
2. By accepting these Terms and Conditions, the User confirms that he/she has read, agrees with and complies with these Terms and Conditions.

Data protection and processing principles
1. In order to provide a correct service, the following data is collected from users: identification data;
– contact data;
– transaction data.

2. In addition to the data directly provided by the user, the Seller also stores and processes functional data (cookies) collected in the online environment and data provided by third parties (Facebook and Google Analytics).

3. The Seller shall keep the data for the period indicated in the Privacy Notice.

4. The Seller shall ensure the protection and processing of personal data in accordance with law and good practice.

5. If it is agreed in the Privacy Policy that the User agrees to receive marketing offers, the Seller may contact the User for marketing purposes.

6. The User has the possibility to modify the consent to receive marketing offers by informing the Seller.

7. The user is obliged to use the e-shop in a secure way. The device used to access the e-shop must be secure and the identification data must be private.

8. If the User becomes aware or suspects that a third party may have access to his or her personal identification data, he or she must immediately change the relevant data in order to prevent others from accessing his or her data.

Buying goods from
1. It is possible to buy goods that are in stock from the e-shop. The price and availability of goods are subject to change without notice.

2. The Seller has the right to withdraw from the sales contract concluded through the e-shop and not to deliver the ordered goods or to provide the service in the following cases:
– the goods are out of stock;
– the price or the characteristics of the goods are incorrectly displayed in the e-shop due to a system error;
– if the buyer does not meet the conditions set by the Seller;

3. If the seller is unable to fulfil the order, the amount paid will be refunded.

4. You can pay for the goods by PayPal or bank transfer to the details on the invoice.

5. The goods will be delivered to the delivery address entered in the order, according to the delivery method chosen by the customer, at the agreed time.

6. If the Buyer fails to collect the goods within 14 days after the agreed date of delivery, the User is deemed to be in breach of the sales contract and does not want the goods. The Seller has the right to unilaterally withdraw from the sales contract and to offset the costs incurred.

Withdrawal from the sales contract and return of the goods
1. The User has the right to withdraw from the sales contract within 14 days from the date of delivery of the goods.

2. The returned product must be in the seller’s packaging and without signs of use. The return of the product must be coordinated with customer support.

3. The transport costs of the product to be returned are paid by the user.

Liability and Dispute Resolution
1. The User may, in the event of non-conformity of the goods with the terms of the contract, invoke the remedies provided by law, i.e. demand performance of the contract, claim damages and terminate the contract.

2. The terms and conditions of the product warranty will be made available electronically in the e-shop.

3. In the case of non-conformity of the goods with the terms of the contract, claims can be lodged with the seller within one month from the date of delivery of the goods. If defects are discovered, the goods may not be used if this would worsen the condition of the goods.

4. To make it easier to resolve any problems later, the buyer must keep proof of purchase documents proving that the goods were bought from the seller’s online shop.

5. Complaints must be submitted by e-mail to support@qilowatt.it or by contacting the e-shop as indicated in the contact details.

6. In the case of defective goods, the consumer has the right to demand first that the goods be repaired or replaced by new goods free of charge.

7. The Seller shall not be liable for defects in the goods caused by improper use, maintenance or damage.

8. The equipment on which the claim is based must be identifiable as the equipment sold by the Seller (serial number).

9. The appliance must not have been opened or its parts replaced.

10. The seller guarantees that the goods sold in the e-shop comply with the standards in force in the European Union.

11. The User may refer a dispute concerning the goods to the Consumer Protection Agency.
